DISPUTE SETTLEMENT
6.1 Civil Litigation
6.1.1 Judicial system concerning civil litigation
The Courts of justice have generalised competence to try and
adjudicate all cases, except where otherwise specified in the Constitution
or other laws. The jurisdiction of the Courts of Justice concerns criminal,
civil, bankruptcy and all cases not being within the jurisdiction of other
courts. The civil litigations are thus mainly under the competence of the
Courts of Justice.
The Courts of Justice consists of three levels: Courts of First Instance,
Courts of Appeal and the Supreme Court of justice.
6.1.1.1 The Courts of First Instance
The Courts of first instance concerning civil litigations is
comprised of general courts, and specialized courts.
6.1.1.1.1 The General Courts
The general courts are classified into Provincial courts and
Kwaeng courts.
Provincial Courts have the competence to try and adjudicate the
following:
1. cases with the amount of money or value of property in
dispute exceeding 300,000 THB
2. non-monetary related case where the claimant requests a
cessation of disturbance, annoyance or damage, for example
claim for eviction or servitude
3. non-contentious cases, for instance, a request for appointing
an administrator of the estate, a request for the court’ s
