LAND LAW
3.1 Land Law in Thailand
3.1.1 Land Allocation
The primary legislation that governs Thai land law is the Land Code
Promulgating Act, B.E. 2497 (1954) (hereinafter "Land code"). The Land
code contains 12 major chapters, including;
1. General provisions are a legal definition and general
principles of the land law
2. Land allocation for the people establishes the National
Land Allocation Committees' power to lay down national
policies on land and develop a plan concerning the land.
3. Delimitation of Right in land confers the authoritative
power to the Director-General of the department of land
under the Ministry of the Interior
4. Issuance of documents showing rights in land set up
forms, rules, and procedures for issuance of land titles and
certificates basing on regulation from the Ministry of the
Interior
5. The land survey sets procedural to make a land survey
and gives the power to officer to enter lands to surveying
and mapping lands
6. Registration of land rights and legal acts establish
registration procedure and set rules of legality on land
transaction
7. Limitation of rights in land for religious purpose
prescribes the use of land for all religions in Thailand
8. Limitation of foreigners' Right over land governs the
rights for foreigners in owning land under ministerial
regulations and approvals.
